TERMS OF SERVICE AND REFUND POLICY
  1. Terms of Service

 

1.1. Descriptions and illustrations.  The descriptions or illustrations that appear on our website are published for the sole purpose of giving an approximate idea of ​​the Tour described in them. They will not form part of the Contract nor will they have contractual force.

 

1.2 Itinerary.  The trip itinerary is available on our website. The itinerary specifies the services included and excluded from the Trip (Itinerary).

 

1.3 Compliance with the itinerary . Without prejudice to our right to change the itinerary (see clause 1.4), we will provide the Trip to you in accordance with the itinerary that we send you in accordance with clause 1.2.

 

1.4 Changes in the itinerary.  We reserve the right to modify the itinerary if required to do so by any applicable legal or regulatory requirement, or if the modification does not materially affect the nature or quality of the Trip. We will notify you in advance of any such event and any changes to the itinerary. This applies to all logistical changes, including those to advertised hotels or vessels. Any change in the itinerary will not give you the right to cancel the Contract, without us deducting the amounts provided in clause 2.1.

 

1.5 Travel material.

 

(a) We will send you a pre-departure information sheet approximately two months before your intended travel start date, which includes, among other things, information about your passport, visa and health requirements, contact details in case emergency, as well as details about the weather, what to bring, recommended reading, etc.

(b) If you notify us in writing before the start of the trip, we can send you an electronic list of birds and mammals. A bound daily checklist will be given to you on the first day of your trip, or emailed to you before the start of your trip.

You may dispense with the Contract if you notify us as indicated in clause 

 

2.1. To cancel the Agreement, you must send us an email at hello@aweima.co. Please include your reservation details to help us identify your reservation. Your cancellation will be effective on the date you email us. For example, you will have notified us in time if you send us an email before midnight on that day.

 

2.2. If you cancel the Contract, we will refund the full price you have paid for the Trip, less the deductions set out in clause 2.3. The refund will be made, if possible, by the method you used for payment.

 

23. Depending on the date you notify us of your cancellation, we will deduct from any refund the following amounts for the Trip you booked, as follows

 

         (i) Tour not confirmed:

 

Free cancellation until the trip is confirmed, or 4 months before the trip start date, whichever comes first.

 

          (ii) Confirmed trip, >4 months before the start of the trip:

 $500 will be retained from your deposit (per person). This fee is non-refundable, even if you meet the requirements of clause 4.6.

 

         (iii) Confirmed trip, <4 months before the start of the trip:

 

The full price of the trip is due and payable, even if you have not yet paid in full.

         (iv) The cost of any non-refundable extra fees and permits issued, including but not limited to domestic flights, gorilla tracking, day trips and pelagics, etc.

 

2.4. No refund will be considered for services not used on the Trip (this includes accommodation, meals, flights, permits and excursions on the Trip).

 

2.5. If you cancel the Trip, we will accept the reservation of another person or persons to replace you, provided that the direct additional costs (for example, the reissuance of domestic airline tickets) are covered by you. If you wish to transfer your booking to another trip, this will be treated as a cancellation and rebooking, and the cancellation charges in clause 2.5 will apply, unless you or we find a replacement for your original booking.

 

2.6. We reserve the right to cancel the trip or the trip experience if there are not enough reservations, two months before the trip departure date. If we cancel the entire trip due to lack of reservations, we will refund all deposits and other payments. An alternative to canceling the trip will be charging a small group supplement (the Supplement). If the Fee is charged and you do not want to pay it, you may cancel or transfer your reservation to another Tour without incurring any cancellation penalty if you notify us in writing no later than seven days after you receive our notice of the Fee charge.

 

2.7. Events beyond our control

 

  1. a) We will not be liable for any failure to perform or delay in performance of any of our obligations under the Agreement that is caused by any act or event beyond our reasonable control (event beyond our control).

 

  1. b) If an Event Outside Our Control occurs that affects the performance of our obligations under the Contract:

 

(i) we will contact you as soon as reasonably possible to notify you; and

 

(ii) our obligations under the Agreement will be suspended and the period of performance of our obligations will be extended for the duration of the Event Outside Our Control. We will arrange with you a new date for the trip once the Event Outside Our Control has ended.

 

  1. c) You can cancel the contract affected by an event beyond our control. To do this, please contact us by phone or by email. If you choose to cancel, we will refund the price you have paid, less any costs we have reasonably and actually incurred in performing the travel services up to the date of the event beyond our control.

 

2.8. Cancellation and special circumstances. 

 

The company will not deviate from the refund policy in point 2.3 due to extreme circumstances. Although it is not a prerequisite for booking a trip, you should purchase trip cancellation coverage to reimburse you in case you have to cancel your trip before departure. Normally, the following circumstances are covered

 

(a) unexpected death, illness or injury to you and/or a fellow traveler that renders you unable to travel, by order of a licensed physician;

(b) hospitalization or death of a non-traveling family member;

(c) natural catastrophes in the country or at the destination;

(d) legal obligation, such as being called to serve on the jury or to appear as a witness in court.

 

2.9 Travel insurance . 

The company recommends that you purchase comprehensive travel insurance when booking your trip, to cover any financial loss due to cancellation for any reason. This period can be from a week to a month. Check with your travel insurance provider to ensure you are fully covered when you purchase travel insurance. It is strongly recommended that if you purchase travel insurance that you do not delay your purchase too much beyond the travel booking date.
